Terms & Conditions

By purchasing our products and/or services, you agree to the following terms. The consent in this agreement applies between the buyer and Monthly Of Sweden AB (org no: 559119-7727) and its subsidiary, hereinafter referred to as MonthlyCup.

Age requirements

To shop in our webshop, you must be of age in the country of your residence. Generally, you are required to be at least 18 years old. The exception for minors applies only if you are in the company of a parent or guardian.

Discounts

Special conditions may occur accordingly to our discount codes. Each issued discount code may only be used by one person per discount code and purchase.

General information

You ensure that the information you provide to us when placing your order are correct. You ensure that the credit card you use when purchasing at our webshop is your own. We reserve for spelling errors and errors on our website. If you are affected by such an error, you will be contacted and informed about the error. We reserve ourselves for any final sales and/or price changes. These terms and conditions may change at any time without prior notice.

Personal data

We save information about your full name, your physical address, your email address, your phone number, your IP address, your details for completing payment, and social security number or personal ID number. Our products are classified as medical devices, and for safety reasons, we need to be able to track which customers have purchased our products. For example, if there would have been anything wrong with a number of products, we need to be able to trace these products to our customers for withdrawal-reasons. Assuming that you as a customer do not divulge it, your data will also be saved in order to be able to contact you regarding news and offers. Hence, your personal information will be saved until further notice. By contacting our customer service through any of our channels, you as a customer may request that your information will not be used for other reasons than to offer you your right to product warranty and for medical device reasons. All employees in MonthlyCup and associated group companies working with our main product have access to your personal information. Current payment information also gives third parties access to information that is relevant to making a payment.

Return and refund

Under the Swedish Distribution and Home Sales Act, you as a consumer (this does not apply to companies) have the right to withdraw the agreement by notifying us within 14 days of receipt of the goods. In order for you to use your right of withdrawal, you must return the item in undamaged condition, in original packaging and in a unbroken parcel. Since the menstrual cup is a hygiene product, we can not take it back if the parcel is opened. When using the right of withdrawal, you are responsible for the return.

Delivery

Your order is usually shipped within 1–2 working days from our warehouse. In special cases, longer delivery times may occur and, if so, we will inform you through our website. Shipping is usually sent by letter and we can not guarantee any delivery time regarding the shipping distance until it reaches the customer. We ship with the Swedish Postal Office. Ordered products are not shipped from our warehouse until payment has been made in accordance with payment terms for the purchase.

Payment


MonthlyCup offers several different payment methods through our website. In case of invoice payment, MonthlyCup has the right to apply a 1 - 30 day payment time at each individual purchase date. The fee for each selected payment method is shown at the time of purchase. In connection with payment, we can conduct a credit report. In case of unpaid invoice, interest will be 20% from the due date. MonthlyCup has the opportunity to transfer or sell the invoice to third parties without the buyer's consent.

Freight

We always offer free shipping.

Packaging and first use

Your MonthlyCup menstrual cup is delivered in a textile bag, together with instructions of use. Your menstrual cup shall be boiled or steam cleaned in our microwave bag before first use.

Notice of defect/complaints

Must be within 3 months of receipt of the product.

Size warranty

You as a customer are offered a size warranty, and the opportunity to change your menstrual cup to a cup of another size within 6 months from the date you placed your order. In order for the size warranty to apply, contact our customer service for information. You only pay for the return of your menstrual cup, hence the freight back to us. A new menstrual cup will be sent after we receive the returned cup.

Current pricing

Prices that appear on our website may differ from the prices of our retailers. We do not offer any compensation for questions concerning price issues regarding price differences between our website and other retailers. By law, we cannot influence our dealers' prices to their customers.

Applicable law

All purchases made through MonthlyCup comply with Swedish law, regardless of where the purchase is made. Disputes are dealt with in the Swedish court with Halmstad District Court as the first instance.

These conditions apply to the websites www.monthlycup.com and www.menskopp.se with sister sites ("Website"). Please read these terms and conditions carefully. By using the Website and/or applying for a Subscription, you agree to the terms.

2. APPLICATION AND COMMITMENT PERIOD

2.1 You may apply for a Subscription only if you are at least 18 years old. We also ask you to note that you can only enter into an agreement on Subscriptions for delivery to an address in Sweden.
2.2 Once you have applied for a Subscription via the Website, we confirm receipt and conclude the Agreement between you and us by sending an e-mail, which at the same time confirms that a product has or will be sent to you.
2.3 The Subscription Agreement means that you will have your selected package delivered once to your specified address. However, certain special Subscriptions (eg "Limited Edition" or similar) may be limited to one item, whereby the agreement only applies to that item and automatically terminates thereafter.
2.4 We reserve the right to refrain from entering into an agreement with you without giving reasons.

3. PRICING

3.1 With the exception of obvious typos, the prices stated on the Website from time to time apply. Prices are stated including VAT.
3.2 The price of a Subscription usually consists of a recurring periodic fee (eg. a monthly fee). The prices that apply to your Subscription are stated in connection with your application.
3.3 Prices and shipping costs may change from time to time. Except as provided in 7.3, you are bound by the prices that were in effect at the time you applied for the Subscription.

4. PAYMENT

4.1 Through the Subscription, you undertake to pay the periodic fee until Termination of the Subscription.
4.2 The first periodic fee is paid in connection with your application for a Subscription and subsequent fees are usually paid on the same day of the following calendar month. However, if your application is not granted (see section 2.4), no fee will be charged. In the case of Direct Purchase, the fee is paid directly upon purchase.
4.3 Payment must be made by credit or debit card or other payment solution offered on the Website. You agree that we may debit the periodic fees from your credit or debit card without further approval until you update your payment information via your account on the Website or by sending a message to info@menstrualcup.com (with the addition of the time we may reasonably require in order to have time to settle the charge).
4.4 Payment can also be made with a value code or gift card issued by us (according to the terms of the voucher or gift card).
4.5 We reserve the right to have a credit report made on you.

5. DELIVERY TIMES

5.1 After entering Subscription, your selected kit will be sent. Depending on when during a calendar month your Application for Subscription has been received, your item will be sent during the same calendar month or next. We do our best to send you your first item as soon as possible. When ordering a Product, it will be sent as soon as possible to the address you specified when ordering.
5.2 You will have your shipment delivered to your door or nearest delivery point. You are responsible for ensuring that MonthlyCup has the correct address and contact information for you so that the shipment can be delivered correctly. In cases where your shipment is delivered to a delivery point, you are responsible for retrieving it and ensuring that MonthlyCup has the correct contact information for you. Should you not collect your shipment after you have been notified that it is at the delivery point and this is returned to us, you must contact us yourself to have the shipment sent out again. The same applies in cases where the shipment has been returned to us when it could not be delivered to your mailbox or door due to you having provided incorrect contact or delivery information. Should we not hear from you within 60 days of receiving the returned shipment, you will not have your order replaced. In such a case, the Subscription will be deemed to have been canceled, and you will be liable for the costs incurred as a result of the shipment not being collected.

6. PRODUCTS AND PACKAGING

6.1 All products on the site, including all samples we provide, are intended for personal use. Unless otherwise stated, we reserve the right to replace or change the product we offer for sale or as part of a collection, without notifying you as a customer in advance.

7. TERMINATION AND AUTOMATIC EXTENSION

7.1 Both you and we may, without stating reasons, cancel a Subscription before the end of the then valid subscription period. If the subscription is not terminated within this time, it will be renewed automatically.
7.2 You cancel the Subscription via your account on the Website or by emailing us at info@menstrualcup.com. We cancel the Subscription by sending a notice of termination to the e-mail address you provided. Your Subscription must be terminated no later than 24 hours before the end of the subscription period, otherwise it will be renewed automatically.
7.3 If you do not cancel the Subscription in accordance with 7.1, the Subscription is automatically extended to the then valid price for the current Subscription (excluding any discounts). However, this does not apply to Products that only include one delivery.

8. RIGHT OF WITHDRAWAL

8.1 If you are a consumer, you may by law regret your Subscription within 14 days (the "Withdrawal period") from the day you receive your goods. In order for you to be able to exercise your right of withdrawal, you must return the product in undamaged condition, in original packaging and in an unbroken letter. Since the menstrual cup is a hygiene product, we can not take it back if the letter is opened. When exercising the right of withdrawal, you are responsible for the return cost.
8.2 You exercise your right of withdrawal by contacting us within the Withdrawal Period and at your own expense return the item to us within 14 days of notifying us that you regret your purchase. You contact us by sending a message to info@menstrualcup.com. We ask you to return the complete item in its original packaging. If you have broken the seal on the product or opened the envelope, the right of withdrawal does not apply for hygiene reasons, see 8.1.
8.3 If you exercise your right of withdrawal, we will refund what you have paid for the item in accordance with our refund policy (see item 10 below).

9. COMPLAINT

9.1 If an item is defective, you can complain about the item within a reasonable time and receive instructions on how to return it. The complaint can be submitted by sending a message with description of the error to info@menstrualcup.com. Refunds for defective goods will be made in accordance with our refund policy (see item 10 below).

10. REFUND POLICY

10.1 If you return an item to us because you have exercised your right of withdrawal (see point 8 above), we will make your refund as soon as possible and no later than 14 days from the day we received your notification that you wish to exercise the right of withdrawal; provided that we have also received the item, or you can show that it has been sent back to us. We will then refund the price for the item. However, you must bear the shipping cost of returning the item to us (see section 8.1). Please note that you can not exercise your right of withdrawal if the envelope is opened.
10.2 If you return an item to us for any other reason (eg. because you believe the item is defective), we will examine the returned item and notify you by e-mail within a reasonable time if your complaint can be accepted and how in that case we remedy the error, by e.g. re-delivery, price reduction or refund. We will make a possible refund as soon as possible and no later than 30 days from the day we received the complained product. We will then refund the price for the item.
10.3 We usually refund money to you using the same method you used to pay us.

11. RESPONSIBILITY

11.1 If you are a consumer, our responsibility for the goods is regulated in the Swedish Consumer Purchase Act (1990:932). In other respects, we are only liable for breaches of these terms and only for a total amount corresponding to your annual fee for the Subscription, unless there is gross negligence or intent. The restrictions do not apply to the extent that they would restrict your rights under mandatory constitution.

12. GROUNDS FOR EXEMPTION

12.1 If the fulfillment of our obligations is significantly hindered or prevented due to circumstances that we could not control, such as labor dispute, fire, lightning, terrorist attack, amended constitution, government intervention and errors or delays in services from subcontractors due to circumstances stated here, this shall constitute a ground for exemption which entails the advance of the time of performance and exemption from damages and other sanctions. However, this should not limit your rights under the Consumer Purchase Act or other mandatory statute.

13. THIRD PARTY WEBSITES

13.1 The Website may contain links to websites operated by one of our partners, advertisers or group companies or by another third party. Please note that we are not responsible for the content of such websites or for the goods or services offered there.

14. MESSAGES

14.1 Messages to us must be sent to info@menstrualcup.com. Messages to you will be sent to the email address or postal address you provided at the time of entering into the Agreement.

15. INTELLECTUAL PROPERTY RIGHTS

15.1 We or our licensors own all intellectual property rights in the Website and all material published on the Website. These works are protected by copyright and all rights reserved.
15.2 You may print a copy for personal use and download excerpts from pages on the Website. However, you may not use any part of our copyrighted material for commercial purposes without first obtaining a license from us or our licensor.
15.3 Through the Subscription, you give us an irrevocable right to quote from the comments regarding us, the goods or the Subscription that you leave on the website, blog or social media and use the quotes on our site, on social media and in other marketing.

16. ADDITIONS AND AMENDMENTS

16.1 We have the right from time to time to make additions and changes to these terms. You are bound by the terms that applied at the time you applied for the Subscription, unless we notify you of any changes to the supplements and you do not notify us within 30 days of the date such notice was sent, that you do not accept such amended terms (whereby the Subscription will expire immediately).

17. TRANSFER OF RIGHTS AND OBLIGATIONS

17.1 You may not transfer your rights or obligations under the Subscription without our prior written consent. However, we may transfer our rights or obligations under the Subscription at any time during the subscription period.

18. APPLICABLE LAW AND DISPUTE

18.1 These terms and the Subscription shall be interpreted and applied in accordance with Swedish law. Disputes due to these terms or the Subscription shall be decided by a general court, with Halmstad District Court as the first instance.
